We strive to ensure all product descriptions, images, and specifications are accurate. However, slight variations in color or design may occur. Product availability is subject to change.

3.2 Intended Use and Customer Responsibility

Our products are designed for residential wellness and relaxation. For Business & Commercial purchases, separate terms apply. It is your responsibility to:

• Ensure the product you select (e.g., spa size, accessory type) is suitable for your intended use, space, and local regulations.
• Use all chemicals (Bromine, Chlorine, etc.) and electrical components (like Air Source Heat Pumps) strictly according to the manufacturer’s instructions for safety and efficacy.
• Verify that your location is within our served regions (worldwide, excluding Asia and select remote regions).

4. Orders and Payment Terms

4.1 Order Process

Placing an item in your cart does not reserve it. An order is only confirmed once we send you an order confirmation email after payment processing. We reserve the right to refuse or cancel any order for any reason, including limitations on quantities, inaccuracies in product information, or issues identified by our fraud prevention protocols.

4.2 Pricing and Payment

All prices are listed in US Dollars (USD). We accept payments via Visa, MasterCard, JCB, and PayPal through our 100% Secure Checkout. You agree to provide current, complete, and accurate payment information. By submitting payment, you authorize us to charge the total amount to your chosen payment method.

Sales tax or VAT, and any customs duties for international orders, are the responsibility of the customer and may be applied at checkout or upon delivery, depending on your local laws.

4.3 Shipping and Delivery

Your order will be processed within 1-2 business days after payment confirmation. You will receive tracking information upon shipment. We offer two shipping methods:

• Standard Shipping (DHL/FedEx): Flat rate of $12.95. Estimated delivery 10-15 business days after shipment.
• Free Shipping (EMS): Available on orders over $50. Estimated delivery 15-25 business days after shipment.

Your Responsibility: Delivery times are estimates. You are responsible for providing a correct shipping address and being available to accept delivery. We are not liable for delays caused by customs, local holidays, carrier delays, or incorrect address information.

5. Returns, Refunds, and Exchanges

Our detailed Returns & Exchanges Policy is incorporated into these terms. Key points include:

• Return Window: Requests must be initiated within 15 days of the delivery date.
• Condition: Items must be unused, in original packaging, and resalable.
• Non-Returnable Items: For safety and hygiene, the following are FINAL SALE:
  • All Chemical Products (Bromine, Chlorine, Active Oxygen, kits).
  • Opened Aromatherapy & Scents.
  • Custom or Special Order swim spas/hot tubs.
  • ClearRay & UV Bulbs.
  • Business & Commercial purchases.
• Refunds: Issued to the original payment method within 3-5 business days after we receive and approve the return. Original shipping costs are non-refundable unless the return is due to our error.
• Your Responsibility: You are responsible for return shipping costs and any associated duties/taxes for international returns, unless the item is damaged or defective.

6. Limitation of Liability

To the fullest extent permitted by law, Swim Spa Store, its directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
